Changes to Social Assistance in Ontario – Important ODSP/OW Update (2019July)

Common Law Ontario The definition of what is common law in Ontario depends on what legal right is at issue. Each Ontario statute defines common law differently, so you could be considered common law for one purpose and not for another. In this article, I look at what family law and estate law rights and obligations a common law partner has. If you and your partner are living common law, then you will be considered a spouse for spousal support purposes if you and your partner have cohabited for three years; or if you and your partner live in a relationship of permanence and have a child together. Once a common law partner is considered a spouse for spousal support purposes, they have the same rights and obligations regarding spousal support as if they were married. You can get a rough idea as to the amount and length of spousal support here. Property Rights Unlike a married spouse, a common law partner in Ontario has no right to seek an equalization of net family property a division of assets.

Just in time for the weekend, new changes were announced to the Ontario Disability Support Program ODSP that would eliminate some of the more punitive restrictions that, in my opinion, contributed to people getting stuck on the program. Credit where credit is due — this is a really important change to ODSP. But much like the Registered Disability Savings Plan RDSP , my main concern is that the benefits of these changes will not be felt by most on ODSP, disproportionately helping the small percentage of users that already benefit from familial, financial and social privilege.

The independent suspension and cambered wheelbase provides incomparable stability and is perfect for both city and all-terrain driving. For the first time ever, I think I may have finally found a wheelchair strong enough to withstand my high usage demands! Perhaps more exciting is the added elevating seat feature I had installed.

This fabulous piece of technology allows me to raise the seat up to bring my eye level to around 5-feet high, allowing me for the first time ever to converse with people face-to-face, naturalizing the social experience that many take for granted. It may seem insignificant, but there is something strange about conversing with someone in a wheelchair: walkies either tower over us or have to kneel down at our level, which I find both embarrassing and awkward.

I am truly astonished at what a difference this technology makes: everything looks different from up here. The raised perspective changes the way I look at everything. If the point of a wheelchair is to give someone his or her independence and this technology allows us to be more independent everywhere we take the chair, how is this it anything but essential? Consider the thousands of dollars being spent right now to renovate buildings to have lower cabinets, light switches, and door knobs when we could simply be building wheelchairs with increased functionality.

I feel this makes far more sense than attempting to remodel existing infrastructure.

This means that evictions can once again take place in Ontario. There remains a process for evictions, but for most evictions that process is now different due to recent changes to the Residential Tenancies Act. Some of the changes related to evictions and other things are as follows:. Evictions can now be fast tracked at the Landlord and Tenant Board LTB if a tenant agrees to a repayment plan with their landlord but then misses a payment.

It is very important for tenants to get legal advice before agreeing to repayment plans because not following the terms of a plan could lead the landlord to get an eviction order without a hearing at the LTB.

Thinking of your experience with tvo. When Tim and Natalie Rose first moved in together, they had no idea that doing so would cause them to lose their income and leave them thousands of dollars in debt. The pair met just before Tim moved to England to study human-rights law, but they knew there was a connection, so they gave long distance a try. Tim has cerebral palsy and requires at least a semi-accessible apartment to accommodate his wheelchair.

Because of the lack of such apartments in Toronto, he had thought he would have to move into an assisted-living arrangement at first, which would have made it difficult for Natalie to visit him.

TORONTO — Ontario is not doing enough to verify that people receiving disability benefits are actually eligible, with most approved applications marked “disabled for life” and very few ever reviewed, the auditor general has found. In her annual report, Bonnie Lysyk said that in the past 10 years, the number of Ontario Disability Support Program recipients has increased by 50 per cent, while the province’s population has grown by only 12 per cent.

Children, Community and Social Services Minister Todd Smith said the ministry is trying to develop smarter ways to identify and prioritize cases for review and confirm eligibility for ODSP benefits. More than 40 per cent of applicants are confirmed as disabled after only a cursory review of their file, the auditor found. Once applicants are approved, 80 per cent of them aren’t subject to any future medical reviews — up from 51 per cent a decade ago — leaving them as “disabled for life,” Lysyk said.
